LAWYER - PROSECUTIONS, PUBLIC LAW &
ADMINISTRATIVE LAW


We have a fantastic opportunity for a Lawyer to join our Public Law &
Regulatory Compliance team in Melbourne.

The successful applicant willhave up to 3 years' PAE litigation experience in the areas of prosecutions, public law and/or administrative law. The role predominately involves acting for State Government and other statutory bodies and agencies in prosecutions, disciplinary proceedings, and reviews of administrative decisions. This is a fantastic opportunity to be involved in a fast paced, impactful area, and contribute to the growth of this practice area at the firm.

Primary Duties and Responsibilities:

- Representing government clients in court and tribunals in prosecutions, disciplinary proceedings, and reviews of administrative decisions (merits and judicial review).
- Advising on investigations and exercising enforcement powers and functions, including infringements, notices and orders and prosecutions.
- Advising clients on subpoenaed documents, identifying documents that may be subject to Legal Professional Privilege, Public Interest Immunity, Secrecy provisions or information that may be a risk for our client. Reviewing and considering appropriate redactions of the documents.
- Drafting affidavits.
- Reviewing evidence, drafting charges and briefs of evidence for criminal proceedings.
- Reviewing evidence and drafting allegations for disciplinary proceedings.
- Reviewing evidence and drafting advice on the prospects of success (criminal and disciplinary proceedings).
- Advising on statutory interpretation, good decision-making, and natural justice requirements.
- Drafting enforcement manuals and decision-making policies.
- Appearing in courts and Tribunals and instructing counsel.
- Representing government bodies in litigation matters.
- Drafting written advice and recommendations.
- Briefing and instructing counsel.
- Conduct of litigation files.
- Research in order to keep abreast of legislation changes and case law.
- Contributing to business development activities, such as writing articles, client presentations, webinars and contributing to the RK Vic Gov CPD day.
- Identifying business development opportunities.
- Opportunity to design and present CPD seminars.
- Time recording and billing.
- Any other reasonable duties as directed by the Principals.

The preferred candidate will demonstrate a desire to work in Public Law and Litigation and have experience or knowledge of prosecutions or criminal procedure. Other relevant litigation experience will also be considered.
